This prohibited the use of hemp and CBD products by active duty and reserve members, despite its legalization on the federal level back in 2018.

Senator Dianne Feinstein proposed an amendment to the National Defense Authorization Act bill that pushes for more research on the health benefits and potential uses for CBD. The tides began to turn for cannabis in the military when the House committee approved an amendment to the National Defense Authorization Act proposed by Representative Ruben Gallego. With the new measures under his amendment, military members would be allowed to apply for reenlistment waivers if:
- They had previously admitted to using cannabis products
- They have been convicted of a misdemeanor cannabis offense on one occasion
- The misdemeanor offense could not have occurred during active duty for the person to qualify for the reenlistment waiver

Things have since progressed further with another proposed amendment to the National Defense Authorization Act being approved by the House of Representatives that would allow for the use of all hemp and CBD products by active service members in the military. This new amendment was proposed by Representative Tulsi Gabbard from Hawaii, in direct response to the Secretary of Defense’s memo. The amendment reads “The Secretary of Defense may not prohibit, on the basis of a product containing hemp or any ingredient derived from hemp, the possession, use, or consumption of such product by a member of the Armed Forces.”
