CBD and THC are the two most abundant cannabinoid compounds found in the cannabis plant, and their interactions are often misunderstood. Military deregulation of CBD has been an uphill battle throughout the years and it wasn’t until recently that any sort of leeway was given to military men and women. As things continue to change, we understand that there can be some gray areas of confusion. The information below will guide you through the recent changes in the military deregulation of CBD.
CBD Is Legalized On The Federal Level
CBD products have less than .3% of THC, so it does not cause any psychoactive effects. CBD products, like the ones sold at Texas Tonix, have been shown to successfully treat ailments and illnesses like inflammation, chronic pains, and anxiety.
The 2018 Farm Bill legalized hemp and all hemp-derived products (like CBD) on the federal level and propelled us into a more modern age of the cannabis industry. While the 2018 Farm Bill is more expansive, the shared power between the state and federal governments over hemp cultivation and production still made it a highly regulated crop throughout different industries.
CBD In The Military Used To Be Zero-Tolerance
The military had previously held a strict zero-tolerance stance on all things cannabis-related. In February of 2020, the Secretary of Defense for Personnel and Readiness issued a memo to all military organizations saying that the use of CBD products in any form is a punishable offense. This prohibited the use of hemp and CBD products by active duty and reserve members, despite its legalization on the federal level back in 2018.
Amendments To The NDAA
Senator Dianne Feinstein proposed an amendment to the National Defense Authorization Act bill that pushes for more research on the health benefits and potential uses for CBD. Through this research, we may find that CBD can even help military members suffering from post-traumatic stress disorders, insomnia or other injuries.
CBD interacts with your body’s endocannabinoid system to help regulate and optimize the way it is functioning. Military men and women suffering from PTSD, depression, or anxiety may find that CBD helps their body remain in homeostasis, where they feel more stable and secure both mentally and physically.

The tides began to turn for cannabis in the military when the House committee approved an amendment to the National Defense Authorization Act proposed by Representative Ruben Gallego. With the new measures under his amendment, military members would be allowed to apply for reenlistment waivers if:
- They had previously admitted to using cannabis products
- They have been convicted of a misdemeanor cannabis offense on one occasion
- The misdemeanor offense could not have occurred during active duty for the person to qualify for the reenlistment waiver

Things have since progressed further with another proposed amendment to the National Defense Authorization Act being approved by the House of Representatives that would allow for the use of all hemp and CBD products by active service members in the military. This new amendment was proposed by Representative Tulsi Gabbard from Hawaii, in direct response to the Secretary of Defense’s memo. The amendment reads “The Secretary of Defense may not prohibit, on the basis of a product containing hemp or any ingredient derived from hemp, the possession, use, or consumption of such product by a member of the Armed Forces.”
